Compendium of Warranties is a 50-state compendium examining specific language found enforceable on a state-by-state basis regarding the exclusion or modification of warranties and limitation of liability provisions in a commercial contract setting. In addition, the summary examines the economic loss doctrine as applied in each state to ascertain its effect on precluding recovery outside of the law of warranty and contract. The compendium is designed to serve as a first-stop tool for the construction of valid and enforceable warranty provisions. However, the compendium provides just a brief summary of the laws governing this area in each state, and is not meant to be a full-scale research tool. Accordingly, it is strongly recommended that individual counsel review warranty and liability provisions on a case-by-case basis to ensure their validity and enforceability in each state.
